يشكل مجلس الإتحاد الأوروبي (Council of the European Union) مع البرلمان الأوروبي الذراع القضائية للإتحاد الأوروبي. يتكون المجلس من وزراء حكومات الدول الأعضاء في الإتحاد. يشار إلى مجلس الإتحاد الأوروبي في بعض الوثائق الرسمية للإتحاد الأوروبي أحيانا بإختصار "المجلس (council)"، كما يطلق عليه عادة بشكل غير رسمي اسم "مجلس الوزراء (Council of Ministers)" حيث تم إعتماد هذا الاسم بشكل رسمي في المعاهدة المؤسسة لدستور الإتحاد الأوروبي.

للمجلس رئيس وأمين عام، حيث يعتبر رئيسا للمجلس وزير الدولة التي ترأس المجلس. أما بالنسبة للأمين العام فيتم اختياره بالإجماع من قبل الدول الأعضاء. و يعتر الأمين العام الممثل الأعلى لسياسة الدفاع و الخارجية المشتركة. ينوب عن المجلس لجنة الممثلين الدائمين و التي تتالف من السفراء أو من ينوب عنهم في البعثات الدبلوماسية للدول الأعضاء. تقوم اللجنة عادة بتحضير أجندة المجلس و التفاوض على القضايا الصغيرة تاركة النقاش و الأتفاق على القضايا الحساسة للمجلس. تتبع للجنة ورشات عمل مكون من موظفين حكومين من الدول الأعضاء يقومون بالنقاش فيما بينهم ومن ثم يتم إحالة ما اتفقوا عليه للجنة ومن ثم للمجلس ليتم اعتماده بشكل رسمي. يدعم عمل المجلس حوالي 3000 موظف حكومي (تموز 2005) بتقديم إستشارت عامة و قانونية بالإضافة لخدمات الترجمة و المساعدة كمفاوض حيادي.

يجب التميز بين مجلس الإتحاد الأوروبي و المجلس الأوروبي ( European Council) الذي يجتمع 4 مرات في العام في ما يعرف بشكل غير رسمي ب قمة الإتحاد الأوروبي أو القمة الأوروربية، حيث يجتمع رؤساء الدول و الحكومات في الدول الأعضاء لتوجيه المجلس الأوروبي و وضع سيساته العليا. كما يجب تميزه ايضا عن مجلس أوروبا (Council of Europe) و هو منظمة دولية( 46 دولة حاليا) منفصلة لا علاقة لها بالإتحاد الأوربي.

The Council is composed of national ministers for the relevant topic of discussion, with each minister representing their national government. The currently effective qualified majority voting rules are defined in the Treaty of Nice. Accordingly, for a proposal to pass, the supporting side needs to surpass three criteria:

1. 50% (if proposal was made by the Commission) or 67% (all other cases) of the members states,
2. 74% of the voting weights,
3. 62% of the EU population (this criterion is only checked upon request by a Council member).

The following table is ranked for the power the member states exert on Council decisions, and lists their population figures (criterion three) and voting weights (criterion two) along with their ruling parties and affiliations to European parties.
