The copyright of this work has expired in the European Union because it was published more than 70 years ago without a public claim of authorship (anonymous or pseudonymous), and no subsequent claim of authorship was made in the 70 years following its first publication. Notice to uploaders: To use this template, the image must meet both of the following two conditions: (1) published over 70 years ago within the EU (excluding the United Kingdom), and (2) the original author's actual identity was not publicly disclosed in connection with this image within 70 years following its publication. Images that lack either of these two conditions should not use this template. Reasonable evidence must be presented that the author's name (e.g., the original photographer, portrait painter) was not published with a claim of copyright in conjunction with the image within 70 years of its original publication. Furthermore, as Wikipedia is hosted in the USA, this tag alone is not sufficient copyright tagging. A second tag must be supplied to indicate why the image is in the public domain in the USA as well. |

This photograph is subject to the provisions of Italy's Law for the Protection of Copyright and Neighbouring Rights because it was either created in Italy or may be considered an Italian work within the meaning of Italian law (Art. 189).
Italian law makes an important distinction between "works of photographic art" and "simple photographs" (Art. 2, § 7). Works of photographic art are protected for 70 years after the author's death (Art. 32 bis), whereas simple photographs are only protected for a period of 20 years from creation (Art. 92). Simple photographs are defined by the law as "images of persons, or of aspects, elements or events of natural or social life, obtained by photographic or analogous processes, including reproductions of works of figurative art and stills of cinematographic film" (Art. 87). If this image meets the definition of a simple photograph and was created prior to 1976 and published without a copyright notice before 1 March 1989, then it was out of copyright in Italy on the date of restoration (January 1, 1996) and is currently in the public domain in the United States (17 U.S.C. § 104A). Outside the US, reusers may need to check the copyright status of this image in their local jurisdiction. Full source, publication date and authorship information should be provided. |
